Terms of Service

Derma-Cloud is a service operated by AppMed Innovation SRL (“we”, “us”), a company registered in Romania.

These Terms of Service govern your access to and use of the Derma-Cloud mobile application, website, API and related services.

1. Acceptance of terms

By creating an account or using Derma-Cloud, you agree to these Terms, our Privacy Policy and Medical Disclaimer. If you do not agree, do not use the service.

You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the service.

2. Nature of the service

Derma-Cloud provides AI-assisted skin screening using an uploaded or captured photo of a skin lesion. The service returns a list of probable skin conditions and confidence scores. This is not a diagnosis and does not replace the advice, diagnosis or treatment of a qualified healthcare professional.

3. Accounts and credits

• You must provide accurate account information and keep your password secure.
• New accounts receive a limited number of free analysis credits.
• Additional credits may be purchased through in-app purchases or other payment methods we make available.
• Credits have no cash value, are non-refundable except where required by law, and may not be transferred.
• We may suspend or terminate accounts for abuse, fraud or violation of these Terms.

4. Acceptable use

You agree not to:

• use the service for any unlawful, fraudulent or malicious purpose;
• attempt to reverse-engineer, copy or scrape the app or API;
• upload images that are not your own or that you do not have the right to process;
• upload abusive, illegal, pornographic or violent content;
• create multiple accounts to abuse the free-credit system;
• interfere with the security or integrity of the service.

5. User content

You retain ownership of the images you upload. By uploading, you grant us a licence to process, store and display the image and results to you as necessary to provide the service. Doctors who use the patient-management feature are responsible for obtaining appropriate consent from their patients.

6. Payments

Payment processing is handled by third-party providers. You agree to their terms. Prices are displayed in the app and may change with notice.

7. Intellectual property

Derma-Cloud, its name, logo, code and content are the property of AppMed Innovation SRL or its licensors. You may not copy, modify or distribute them without permission.

8. Limitation of liability

To the maximum extent permitted by law, AppMed Innovation SRL and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data or goodwill, arising from your use of the service.

In any event, our total liability will not exceed the amount you paid to us in the 12 months before the claim, or EUR 100, whichever is greater.

9. Indemnity

You agree to indemnify and hold us harmless from any claims, damages or expenses arising from your use of the service, your content or your violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms or for operational reasons. You may delete your account at any time by contacting us.

11. Governing law and disputes

These Terms are governed by the laws of Romania and the European Union. Any dispute will be subject to the exclusive jurisdiction of the courts of Iași, Romania, unless mandatory consumer law requires otherwise.

12. Changes

We may update these Terms. Continued use after changes are posted constitutes acceptance.
